Assertions herein are supported by documentary, audio and personal testimony evidence and proof.\ \ \ Dear Indiana Legislator,\ \ On January 16, 2008, Randall Terry Shepard, Chief Justice of Indiana delivered his 21st State of the Judiciary address to a joint session of\ the Indiana General Assembly, as required by Indiana Constitution. In conclusion, he stated:\ \ "In short, this is a judiciary with reform in its heart, its feet on the ground, and its mind focused on its customers."\ \ Having experienced the quality of justice and conduct of judges in Indiana courts first hand, we, the undersigned, will not even waste your time discussing the judge's premise for the content of his speech. Suffice it to say that Mr. Shepard (or rather \'d2RANDELL SHEPERD\'d3, see footnote\ -FN1) is correct to refer to "customers" as rule of law and justice have become commodities in Indiana courts and are sold to the highest bidders through abuse and disdain for the law, including the highest law of the Land, i.e. the Constitution for the United States which is also enshrined in the Indiana constituion and which every elected official, including Mr. Shepard himself and his band of state court judges have sworn to uphold and whose violation by any judiciary or official swearing such allegiance would render them without jurisdiction and devoid of their office and committing treason (as per the Constitution and the US Supreme Court directives).\ \ Yet, there isn't a day gone by that the said Constitution and laws of Indiana are deliberately and knowingly violated by the Indiana judiciary as part of their insidious and ever expanding judicial tyranny which they perpetrate upon the multitude of unsuspecting people of Indiana who are unknowing of the laws and their rights under them including their constitutional rights that the said judiciary so contemptuously and deliberately ignore and trample upon. They do so with the full knowledge of the Indiana Court of Appeals (IN-CA) and Supreme Court (IN-SC), which is ruled by an iron fist by the said Chief Justice.\ Therefore, Mr. Shepard himself is ultimately, as the chief administrator of Indiana courts with direct responsibility to oversee all Indiana judges, is responsible and answerable. This is in addition to the fact that Mr. Shepard himself has known about (informed by the undersigned on more than one occasion) and committed and indeed aided and abetted in such judicial atrocities not least by covering up those unlawful violations.\ Such judicial atrocities by Indiana judges include routine deprivation of rights, fraud, bullying and intimidation, unlawful and fraudulent orders, often without jurisdiction, benefiting the judges themselves and county prosecutors, along with other county and state agencies that financially benefit from such unlawful orders and atrocities including deprivation of constitutional rights, livelihood, family, liberty and freedom, etc. Children are ripped from both parents or one parent (usually the father) so that the reprehensible and unconstitutional monetary incentives maybe attained to enrich the pockets of the judges, prosecutors, and other organs of the state. In doing so, many Indiana courts and judges (e.g. Judge Rex L. Reed of Kosciusko Circuit Court, judges Shewmaker and Bonfiglio of Elkhart, etc- see -FN2) have discarded Indiana laws and the Constitution and have replaced them with their human rights violations including, but not limited to fraud, lies, case fixing, ruling without jurisdiction and tyranny aided and abetted by attorneys either through willing collusion (e.g. attorney Max K. Walker, Jr., in Elkhart) or intimidation and fear of retaliation by judges. Not many attorneys have the courage of their convictions to stand up for the rule of law and the Constitutional rights of people and their clients. E.g., attorney Michael A. Wilkins, was disciplined (New York Times article, -FN3) by the IN-SC for expressing and bringing to its attention even a mildest form of corruption, cronyism and secret underhand and corrupt dealings by the IN-CA. This was not the only time that Chief judge Shepard has attempted and indeed perpetrated cover up of judicial misconduct by Indiana judges. If it were not for the rare courage of the attorneys involved and the faithful publication of the event by New York Times (e.g. Indiana media have consistently refused to publish details, supported by evidence, of other judicial atrocities they have been provided with), this too would have been successfully covered up by judge Shepard and his outfit as no doubt there are many other instances that they have succeeded. Indeed, he has directly encouraged and covered up judicial corruption and fraud (in addition to the above atrocities, one may add falsification of official county court records by his appointed judge, Rex L. Reed, as well as falsification of IN-CA dockets to conspire and cover up secret communications between trial judge Reed and IN-CA with a view to obtaining the desired appellate results). In addition, judge Shepard has appointed certain judges with the express purpose of violating, strangling and impeding rule of law and due process and deprivation of constitutional rights of people resulting in the destruction of lives, families and liberties.\ \ Additionally, judge Shepard himself has lied and denied facts that had been made available to him and recorded by the IN-CA.\ \ (Certain relevant US Congressional committees as well as federal law enforcement agencies have been provided evidence of judicial misconduct and corruption by Indiana judiciary all the way through to and including IN-SC and judge Shepard himself. A "Greylord" (-FN4) type of investigation has been sought and is anticipated into Indiana judiciary.\ \ So, the only statement the judge made which could reliably be accepted as true is the concept of "customers". No, man or woman ever comes in front of a judge expecting himself/herself, or the justice he/she seeks, to be treated as a commodity. Nor what he/she expects from the court to be less than justice in accordance with the law of the Land and his/her constitutional rights.\ True to form, judge Shepard, his colleagues on the IN-SC and all Indiana lower court judges, have shown that they treat justice as a commodity, therefore, it is logical that the highest bidders win, albeit the said winners are no other than the selected ones, as shown by the example supplied herein.\ \ The innocent may wonder how we have come to enjoy such prevalent judicial tyranny and human rights atrocities by the very judges who are supposedly elected by and who are supposed to be the servant of, "We The People". This has come to be because the judicial branch has, for all intensive purposes, and through return to a feudal system, subjugated the executive branch to its will through fiat, intimidation and co-opting into its corrupt practices and sharing of the ill-gotten proceeds. (One may just ask almost any county prosecutor, or sheriff, etc.)\ \ The mainstream media, supposedly free and evermore watchful for the good of the people, have abdicated their responsibility either through deliberate collusion (by co-opted media owners and certain reporters) or through fear of exclusion, "making waves" or disturbing the status quo, relegating themselves to just selling soaps. A most relevant and cogent example (-FN5) of such abrogation of duty and responsibility by the media and emasculation by the judiciary of freedom and rights resulted in censorship by Fountain County Judge Susan Orr Henderson, issuing a restraining order prohibiting WXIN 59 TV in Indiana from airing a complaint about the county's Department of Child Services (another beneficiary of judicial corruption and destruction of families). Such collusion and abrogation of responsibilities by the media also takes the form of refusal to investigate or consider for publication when the said media are provided with the accounts, supported by evidence and testimonies, detailing such human rights and judicial atrocities. One question is whether, knowing the said atrocities, the media carry any less responsibility for the destructive consequences of the said atrocities than do the perpetrating judiciary!\ \ The legislative branch has, thus far, been hiding its inaction, if aware of such atrocities, under the guise of such false pretexts as "Separation of Powers", etc. Each branch has overlapping function with regard to other two branches. Indeed, it is incumbent upon one branch, particularly the Legislative, to act to restrain and bring into the fold of lawfulness the actions of the members of other branches and require them to abide by the laws of the Land. Furthermore, it is incumbent upon the Legislative branch to investigate and prosecute officers of the other branches when they commit egregious violations of their oaths of office and the laws as many judges (of counties, IN-CA and IN-SC) have perpetrated and continue to perpetrate. Immunity, a self-granted Crown privilege prohibited under the Constitution, is no bar for refusal by the Legislative branch to prosecute corrupt judges and disrobe them of their offices. (See below, end of text, regarding Jefferson's comment on corrupt judiciary.)\ The legislative branch may have chosen to keep silent in the face of such atrocities as a way of placating the judiciary, however, before long, and unless such miscreant judges' feet are held to the fire of the Constitution and law of the Land, the legislative branch too will fall under the yoke of judicial tyranny.\ \ What is clear is that many Indiana courts and judges still operate and dispense "justice" through procedures that not only violate the due process, but, if anything, is more akin to lynch-mob rule and mentality.\ \ Therefore, we the undersigned and others, intending to ensure that judicial corruption in Indiana and the role of the Legislature in combating it, will be one of the top issues and priorities of the upcoming and future elections, request the following from each and every one of you the legislators:\ \ 1- To initiate and institute a criminal investigation of the Indiana judicial system and ALL its judiciary bar none with a view to instituting impeachment of same.\ \ "Judicial Independence" does NOT mean free for all by the judges including corruption and violation of laws and Constitution, and tyranny upon people. Judiciary may have "independence" WITHIN the limits of the law and the Constitution. You the legislator are responsible for maintaining this limit upon the judiciary.\ \ 2- The investigations to be carried by a group of prominent members of communities from around Indiana recommended by the people in each community and to exclude any judge or lawyer.\ \ \ 3- To include in the investigation the roles of Indiana Attorney General, Steve Carter, and his deputies (inter alia, David Arthur, et al.) in colluding with and aiding and abetting and covering up such atrocities. Evidence exists that they have lied to federal courts (as far afield as in state of Massachusetts) in their cover up of Indiana judges' unlawful activities.\ \ 4- Immediately demand the resignation of judge Randall Terry Shepard.\ It may be noted that the undersigned sent judge Shepard an Open Letter (-FN6). By any account, judge Shepard has aided and abetted and conspired to cover up and perpetrate violations against the people.
